Purposes of processing
Simovision bv collects and processes the personal data of customers for customer and order management (including customer administration, tracking orders/deliveries, invoicing, monitoring solvency, and sending marketing and personalised advertising).
Legal bases for processing
Personal data is processed on the basis of Article 6.1 of the General Data Protection Regulation:
- (a) consent
- (b) necessary for the pursuit of our legitimate interest in conducting business.
To the extent that the processing of personal data takes place on the basis of Article 6.1(a) (consent), the customer always has the right to withdraw the given consent.
Transfer to third parties
Where necessary to achieve the stated purposes, the customer's personal data may be shared with other companies (of Simovision bv) within the European and non-European Economic Area that are directly or indirectly affiliated with Simovision bv, or with any other partner of Simovision bv. Simovision bv guarantees that these recipients will take the necessary technical and organisational measures to protect personal data.
Retention period
Personal data processed for customer management will be retained for the period necessary to comply with legal requirements (including in the area of order processing and accounting). Personal data processed for marketing purposes will be retained until the person concerned requests its deletion.
Right of access, rectification, erasure, restriction, objection and portability of personal data
The customer has the right at all times to access their personal data and may have it corrected if it is inaccurate or incomplete, have it deleted, have its processing restricted, and object to the processing of their personal data on the basis of Article 6.1(e) or (f), including profiling based on those provisions. Furthermore, the customer has the right to obtain a copy (in a structured, commonly used and machine-readable format) of their personal data and to have the personal data transferred to another company.
In order to exercise the above rights, the customer is asked to:
- adjust the settings of their customer account themselves; and/or
- send an email to the following address: order@simovision.eu
Direct marketing and professional communications
Simovision processes certain personal data of medical professionals (such as name, work address, email address and specialisation) on the basis of its legitimate interest in bringing its products, services and innovations to the attention of professionals in the medical sector. This interest consists of providing relevant information about optical and medical products, training, events and other professional services that align with the activities of medical practitioners.
Processing is limited to data that has been made public by the data subject themselves (for example via professional registers, hospitals or practice websites) or that was communicated directly in the context of a professional relationship with Simovision. This processing is based on Article 6(1)(f) of the General Data Protection Regulation (GDPR).
Simovision takes reasonable measures to limit the impact on privacy:
- Communications are aimed at professional purposes and are sent at an appropriate frequency.
- Every recipient has the right at all times to object to receiving such communications (via an unsubscribe link or by contacting order@simovision.eu).
The customer has the right to object free of charge to any processing of their personal data for direct marketing purposes. Upon objection, Simovision will immediately stop sending marketing messages to that person.
When you register for a newsletter, training or event organised by Simovision, we process your data to inform you about similar future activities. Here too we rely on our legitimate interest in informing medical professionals about relevant developments. You can unsubscribe at any time via the link at the bottom of each message.
Complaints
The customer has the right to lodge a complaint with the Data Protection Authority (Drukpersstraat 35, 1000 Brussels – contact@apd-gba.be).
